1. General Provisions
1.1 These General Terms and Conditions (hereinafter the “Terms”) apply to transactions between customers (hereinafter the “Buyer”) of the online store proair.ee (hereinafter the “Online Store”) and the owner of the online store proair.ee, Pro Air OÜ (hereinafter the “Seller”), regarding the legal relationships arising from the purchase of products from proair.ee. These Terms set forth the rights and obligations between the Seller and the Buyer, liability, the terms of purchase and payment for products, delivery and complaint procedures, and general information about the products and services offered by the Seller.
1.2 The Seller reserves the right to amend or supplement these Terms and Conditions without prior notice. Any changes will be posted on the Online Store’s website and will take effect upon publication on the Online Store. An order placed before the changes to the Terms and Conditions take effect will be subject to the Terms and Conditions in effect at the time the order was placed, unless otherwise provided by law or in these Terms and Conditions.
1.3 The Seller shall not be liable for any damages arising from the Buyer’s failure to review these Terms and Conditions.
1.4 In addition to these terms and conditions, the legal relationships arising from purchases made through the Online Store are governed by the laws in force in the Republic of Estonia.
1.5 The buyer has the right to file a justified complaint with the Consumer Protection Board. The Consumer Disputes Commission is authorized to resolve disagreements and disputes arising from a contract between a consumer and a business that the parties have been unable to resolve by mutual agreement. The review of a complaint by the Consumer Protection Board is free of charge for the parties. 2. Customer Information and Data Protection
2.1 Personal data provided by the Buyer to the Seller will be processed in accordance with the Data Protection Act. Data will be disclosed to third parties only with the Buyer’s consent or in cases provided for by law.
2.2 The Buyer is responsible for ensuring that their email address and password do not fall into the hands of third parties. The Seller shall not be liable for any consequences resulting from the Buyer’s login credentials falling into the hands of third parties through the Buyer’s own fault.
2.3 The Buyer is responsible for the accuracy of the information provided. The Seller shall not be liable for any consequences resulting from inaccurate information entered by the Buyer.
2.4 If the information on the Buyer’s registration page changes, it must be updated on the Online Store’s website before placing a new order. The Seller shall not be liable for any consequences resulting from incorrect information entered by the Buyer or from such information becoming outdated.
2.5 If the Buyer attempts, through their actions, to disrupt or interfere with the operation of the online store, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer’s access to the online store’s website and refuse to serve them in the future.
3. Product availability, price, and accuracy of information.
3.1 All prices on the proair.ee website include VAT.
3.2 Order Processing Fee – The seller reserves the right to charge an additional fee for processing any order.
3.3 If the price of a product has become unreasonably low due to a system error, Proair OÜ reserves the right not to sell that product, and the buyer will receive a refund.
4. Placing an Order.
4.1 The buyer can place an order on the proair.ee website through the website’s ordering system, by email at info@proair.ee, or by phone using the number listed on the online store’s website.
4.2 Submitting an order does not automatically reserve the product. After an order is submitted, a representative of the Seller will contact the Buyer as soon as possible to confirm the order and agree on the details.
4.3 If it is not possible to fulfill the order (the product is out of stock, the product is defective, etc.), the Seller has the right to offer the Buyer the option to select an equivalent product. If the Buyer does not wish to receive a replacement product, the order will be canceled, and if payment has already been made, the Seller will refund the money to the Buyer’s account within 14 days of receiving the transfer.
5. Conclusion of the Contract
5.1 The sales contract between the Buyer and the Seller is deemed to have been concluded at the moment the Buyer has paid the first installment for the product into the Seller’s bank account or in cash to the Seller’s authorized representative.
6. Canceling an Order
6.1 The Buyer has the right to cancel an erroneous order by notifying the Seller via email, telephone, or other channels.
6.2 The order will be automatically canceled if the Buyer has not made the first payment within two business days after the payment due date.
7. Payment for Products
7.1 The Buyer has the right to pay a 50% advance payment for the purchase. In such a case, the Buyer may pick up the product at the Seller’s pickup location once the remaining amount has been paid.
7.2 The Buyer may choose from the following payment methods to pay for the purchase: bank transfer to the Seller’s bank account, cash upon receipt of the product, or installment payments.
7.3 If the Buyer has not made the first payment for the product within the time limit specified in Section 6.2 of these Terms and Conditions, the Seller has the right to cancel the order without notifying the Buyer.
How can I buy or order items from the www.proair.ee online store?
ORDER WITH PAYMENT OBLIGATION – Add the selected products to your shopping cart. You can make changes in the shopping cart (change a product, remove a product, etc.). If everything is to your satisfaction, click the “PROCEED TO SHOPPING CART” button.
You can choose whether to log in as a registered user or as a guest (fill in the required fields; if necessary, enter your shipping address and billing address separately). Once you’ve made your selection, click the “Log In” or “CONTINUE” button.
Select a delivery method (Pick up in person; Itella Smart Post; Itella Smart Courier (if the package exceeds the size limits for Smart Post, you can only order it for pickup in person or via Smart Courier)). Click the “CONTINUE” button
Choose the payment method that works best for you. Check the box labeled “I agree to the Terms of Use and will comply with them,” and be sure to review the general terms and conditions first. If everything is in order, click the “ORDER WITH PAYMENT OBLIGATION” button.
An email will be sent to the email address you provided, with the subject line, “THANK YOU FOR YOUR PURCHASE FROM THE PROAIR OÜ STORE!”
We’ve received your order!
DELIVERY – Goods will be delivered to you within 3–20 business days, depending on the payment and delivery terms. The maximum delivery time is 20 days. If this period is exceeded, the customer has the right to request a refund and cancel the purchase. The refund will be credited to the account from which the payment was made.
PAYMENT OPTIONS:
MONEY – You can pay in cash at our pickup location or to the courier. A 0.99% order processing fee will be added to the price. If you pay the courier in cash, an additional 2.50 EUR will be added to the shipping fee.
BANK TRANSFER – You can pay the invoice by bank transfer (as either an individual or a business). Processing the order will take longer.
LEASING – If you don’t have the necessary amount available right away, you can take advantage of our leasing option.
CARD PAYMENT – Card payment option available at the pickup location.
PANGALINK – a payment option on the website
Pro Air OÜ (www.proair.ee) – accepts payments only in euros.
Pro Air OÜ is the controller of personal data; Pro Air OÜ transfers the personal data necessary for processing payments to the authorized processor, Maksekeskus AS.
8. Installment Payments
8.1 The Buyer may apply for installment payments to pay for purchases.
8.2 The Seller acts as an intermediary for its partners’ installment payment service by forwarding the Buyer’s application and supporting documents to the partner and communicating the partner’s decision to the Buyer. The Seller will not comment on or provide reasons for any rejections.
9. Product Delivery
9.1 The Buyer may pick up the product at the Seller’s pickup location at Värvi 5, Tallinn, after the Seller’s representative has notified the Buyer that the product has arrived at the pickup location.
9.2 Upon request, the product will be delivered to the Buyer by courier or to a package locker. In such cases, a delivery fee will be added to the product price in accordance with the price list provided on the proair.ee website.
9.3 Pro Air OÜ is responsible for delivering products purchased from the Seller to the Buyer. Delivery is made within Estonia and, if necessary, within Europe (for delivery outside Estonia, please contact us at 533 222 58 to separately agree on the delivery method and price).
9.4 The buyer must notify the seller of any nonconformity of the goods with the terms of the contract within a reasonable time after the buyer became aware of, or should have become aware of, such nonconformity. If the buyer has entered into the sales contract in the course of their economic or professional activities (e.g., a company), they must inspect the purchased item immediately or have it inspected.
10. Refusal to Make a Purchase
10.1 In accordance with the laws of the Republic of Estonia, a consumer who is a natural person has the right to cancel a sales contract within 14 calendar days of receiving the product. If the goods to be returned are damaged, the buyer is liable for any decrease in value resulting from their use, in order to verify the nature, characteristics, and functionality, the buyer should handle and use the item only in the manner that would normally be permitted in a store.
10.2 You may inspect the merchandise to determine whether it is suitable or unsuitable; inspecting the merchandise is equivalent to trying it out in a retail store before purchase. For example, you must not pour water into a humidifier or air cooler, or remove the filters from the packaging of an air purifier and use the device—for health and hygiene reasons.
10.3 The right to withdraw from the sales contract does not apply to products that have been manufactured with the buyer’s personal characteristics or specific needs in mind (the device has been modified according to the customer’s specific request).
10.5 The buyer has the right to withdraw from a contract concluded by means of communication without giving a reason within 14 days, in accordance with the laws in force in the Republic of Estonia.
10.6 The Buyer agrees to bear the shipping costs associated with returns, unless the product delivered to the Buyer does not match the order.
10.7 Upon termination of the contract, the product must be returned immediately (within at least 30 calendar days).
10.8 In the event of a product return, the Seller offers the option to replace the product with another one, with a corresponding price adjustment.
10.9 If the Buyer does not wish to receive a replacement product, the Seller shall refund the amount paid for the product to the Buyer’s bank account within 14 days at the latest. The refund will be made only to the bank account from which the order was paid.
10.10 The Buyer agrees that, in the event of an abuse of the right to terminate the sales contract, the Seller may refuse to provide services to the Buyer in the future.
11. Filing a Claim and Conditions
11.1 Before submitting a claim, always review the proair.ee Terms of Use. Click here to open the claim form.
11.2 For private individuals, the period for filing claims regarding the goods is 24 months from the date of delivery. For legal entities, the manufacturer’s warranty period applies. The warranty does not cover parts that wear out due to normal use of the product.
11.3 During the period for filing claims, the Consumer is entitled to have the product repaired or replaced free of charge. If the defect is attributable to the manufacturer, all material and manufacturing defects, as well as the cost of labor and replacement parts, will be covered.
11.4 If the Goods have been sold to a Consumer, any defect in the Goods that becomes apparent within the first six months is presumed to have existed at the time the Sales Contract was concluded, and the nature of the defect must be determined by Pro Air OÜ, which operates in the fields of businessand professional activities.
11.5 Pro Air OÜ has the right to delegate the investigation of a defect to the manufacturer of the device.
11.6 If a defect in the goods is discovered, the Consumer must notify Pro Air OÜ within two months of the discovery of the defect by filing a claim (VÕS § 220(1)). If a claim is filed, Pro Air OÜ shall bear the costs associated with repairing or replacing the Goods during the first six months following their delivery to the Consumer, including, in particular, transportation, postage, labor, travel, and material costs (VÕS § 222(4)).
11.7 Over the next 1.5 years, Pro Air OÜ will bear the relevant costs only if the Consumer’s claim was justified.
11.8 A notice (claim) must be submitted within two months of the discovery of the defect. If this deadline is missed, the User loses the right to demand that Pro Air OÜ repair or replace the Goods.
11.9 Pro Air OÜ undertakes to respond to a complaint submitted by the Consumer in writing or in a form that can be reproduced in writing within 15 days (Consumer Protection Act § 19(6)).
11.1.1 In the event of replacement of Defective Goods or a part thereof, Pro Air OÜ has the right to require the User to return the Defective Goods or the part thereof. If the User requests repair of the Goods and the request is justified, but Pro Air OÜ fails to do so within a reasonable time, the User may repair the Goods themselves or have them repaired by a third party and demand reimbursement from Pro Air OÜ for the reasonable expenses incurred in doing so.
11.1.2 If repair or replacement of the Goods is not possible or fails, if Pro Air OÜ unjustifiably refuses to repair or replace the item or fails to do so within a reasonable time after being notified of the nonconformity with the terms of the contract, and the Consumer does not wish to or cannot have the repairs performed by a third party, the Consumer has the right to withdraw from the Sales Contract and return the Goods to Pro Air OÜ.
11.1.3 Pro Air OÜ undertakes to refund the purchase price paid under the Sales Agreement within 14 days of receiving a justified Notice of Withdrawal and the return of the Goods to Pro Air OÜ.
11.1.4 Claims must be supported by a document proving the purchase.
11.1.5 The warranty does not cover instruction on the use of the product, adjustments, maintenance, cleaning, restoration of the product’s commercial appearance, or the repair of defects caused by failure to follow the instructions for use.
11.1.6 The right to file a claim does not extend to damages incurred during transport after the product has been delivered to the buyer.
11.1.7 Pro Air OÜ will not remedy defects that become apparent during the warranty period free of charge if they are caused by:
• software errors installed on the device;
• normal wear and tear;
• improper use or maintenance (including cases where the device has been repaired or maintained by a person not authorized by the manufacturer);
• tampering with, replacing, or removing the serial number, inspection label, or identification label of the device and/or component;
• defects in the device that Pro Air OÜ disclosed to the customer prior to the purchase;
• external factors (including, among others, lightning, electrical voltage that does not meet specifications and voltage fluctuations, moisture, liquids, mechanical damage, etc.);
• the product does not function due to the owner’s fault, as a result of improper use, failure to follow the user manual, or if defects arose due to careless storage, maintenance, or overloading of the product;
11.1.8 Pro Air OÜ relies on an expert assessment conducted by a representative authorized by the manufacturer to determine liability. If the expert assessment reveals that the defects were caused by the factors listed above but the device can be repaired, the Consumer has the option to order a paid repair. A device (Product) that has suffered liquid damage, moisture damage, or mechanical damage will continue to be eligible for repair only on a paid basis.
11.1.9 An inspection fee must be paid for the inspection (diagnostics) performed on the device (Goods) if Pro Air OÜ is not responsible for rectifying the defect found in the device and the device cannot be repaired. The Consumer must also pay the inspection fee if the inspection (diagnostics) does not reveal any defects in the device and the device complies with the manufacturer’s technical requirements.
11.2.1 A private customer is not required to pay the appraisal fee during the first six months following the delivery of the Goods.
11.2.2 If the Consumer does not file a claim within 6 months (up to 2 years) of receiving the Goods or does not agree with Pro Air OÜ’s position, the Consumer must prove that:
• this constitutes a defect (non-conformity with the terms of the contract);
• the defect, or the cause of the defect, existed at the time the device was delivered;
• Pro Air OÜ is responsible for the shortage.
If Pro Air OÜ has provided a sales warranty for the equipment, Pro Air OÜ guarantees that any defects will be remedied in accordance with the terms of the sales warranty.

Processing Fee
The service provider has the right to charge the customer—i.e., an inspection fee—in accordance with the price list provided, if the product is found to be in working order or the customer declines to proceed with a paid repair, except as provided in § 218(2) of the Law of Obligations Act.
